These Terms of Use which, together with our Privacy Policy, apply to your use of our website and other websites, mobile sites, any Mobile Apps, applications and services made available by us (“website”).  Your use of the website is deemed to be your conclusive acceptance of the Terms of Use and our Privacy Policy.

If you do not fully agree to all of the clauses contained in these Terms of Use, DO NOT use our website or any of our Mobile Apps.

No endorsement

We are not responsible in any way whatsoever for user posts, selections and decisions. The presence of any post or third party information on our website does not indicate an endorsement by us of that third party, post, user or their content.

Third parties

Community Bond’s website and any Mobile Apps use a complex mix of multiple third party providers to deliver its services. Examples include (but are not limited to) Maps API to assist with location based information; an SMS gateway to send SMS messages to the users; a payment gateway to accept secure payment online, etc. While we follow the best industry practices to help keep your personal information safe, we try to make sure our third party service providers do the same. Because we rely on a complex mix of services from third party service providers, we cannot totally warrant the security of information since no internet data transmission to or from our online products or services, processing or storage can be guaranteed to be 100% secure. 

Website and mobile apps

Community Bond does not guarantee that the website and mobile apps will be free from viruses, or that access to the website will be uninterrupted.

You must create a username and password which you must keep secure. If you suspect that your username or password is being used without your authority, you must immediately report this to Community Bond.

Warranties

You warrant that you are at least 18 years old.

You warrant that all information provided by you to us:

a.             is true and correct;

b.            is not misleading or deceptive, defamatory or obscene;

c.             does not infringe a third party's intellectual property rights; and

d.            can be lawfully published by Community Bond.

You will indemnify and keep Community Bond indemnified against all claims, costs, expenses, damages, liability or losses, of any kind whatsoever, arising in relation to a breach of any of the above warranties.

User signup and verifications

Besides web and email sign up, you can sign up to Community Bond via your Twitter, Facebook or LinkedIn account.  If you do so, we may gather some information about you from these social networks. Your social network profile picture may be used as your Community Bond profile picture. Additionally, Community Bond provides tools to help verify the identity of members and other site users. These tools may include mobile phone verification, payment verification, and/or integration with social networking sites such as Facebook, Twitter and LinkedIn. Connection of your social network accounts to your Community Bond account will be shown on your public profile page. When you connect your Facebook account, all your Facebook account details will be masked on your Community Bond public profile except the total number of friends. It’s your decision to link these social networks accounts to your Community Bond account, as the more connected social networks accounts to your Community Bond account, the more appealing your public profile will look to other users.You agree that Community Bond Identity Verification Services may not be fully accurate as they utilise information supplied by users and other service providers.

You can view how your public profile looks to other users via the left menu bar of the “My Profile & Settings/ My Public Profile” section. You expressly agree that we may also collect data on your internet behaviour from these social media sites, and from other services.

User public profile and personal info

You can check your public profile (how your profile appears to other users) via the left bar menu in the “My Profile & Settings” section. Your public profile will show your user type, user name, your picture, the subscriber verification methods you have provided, the community medals given to you by other users, the date you joined the Community Bond website and the last time logged in. You can hide or show your first name and family name if desired during the registration process or later via the “Edit Account Details” section. Other Community Bond users can send you private messages from your public profile page. Private messages between you and another Community Bond members will be visible only to you and the recipients. 

Community Bond was designed to unleash the full potential of social networking for communities (local and beyond). To facilitate communication between users and any community, some of these methods are visible to all members. You understand and accept that other users may send you unsolicited communications via Community Bond’s private message service. You understand and accept that we cannot control these actions, however, you can easily block other users if desired by clicking their user name and blocking them from their public profile page, via the “Block Contact” button. An alternative is the “Block Users” section under the “My Profile and Settings” section.

Please note that if you choose to share your personal information with other Community Bond members, you do so at your own risk. We don’t recommend that you share your personal contact information.

Public channels access, content creation and editing

Community Bond offers you multiple public “channels” to allow you to post and create content in a structured and organised way, and to efficiently communicate with the communities around your home, destination or actual location based on specific topics, services or interests. Each channel covers a specific service and group of categories.  A channel is a classification of community information, services groups and communication. Channels include categories to make postings and finding information easier for users.

You understand that content created on a channel such as a post or reply is public and can be seen by all users. You consent that when you create a content on a channel such as a post, your details such as user name, public profile page, mobility profile used, suburb and relative distance to other users will be visible to other users. Additionally, if you tick the “Show Post Exact Location” when you create a post, the exact location of the mobility profile you have selected will be shown on the map to other users too. This exact location is:

  1. the registered address / location for the Homezone mobility profile if you were using the Homezone mobility profile when you created the post or content;
  2. the target location for the destination mobility profile if you were using the destination mobility profile  when you created the content; or
  3. your actual physical GPS location if you were using the Onzmove mobility profile when you created the content.

 This can be useful if you want to geo tag your posts and benefit from our location based “virtual community notice boards”. It’s your responsibility to fully understand and select the right privacy settings and respecting the privacy of others before creating any content .Other content may inherit an existing privacy setting. You should be aware that personably identifiable information you choose to disclose online on the communitybond.com.au website may be used by other users and third parties in a way that is beyond our control.

We reserve the right, at our discretion, at any time to limit some user types or some mobility profiles to create or search for created content by other users for some or all channels. You can edit or delete the content you have created via the “My Activity Log” section. In some sections, we have limited your ability to remove or edit the content you have created.

Private groups creation and access

Unlike channels, private groups allow their members to communicate privately. Private groups can be created in some channels through the “Create Private Group” tab. Once a group is created, it will be associated with the user who created it. The group public attributes will show the following:

  • Channel name
  • Group name
  • Group picture
  • Group description
  • Administrator attributes such as user name, user public profile, user mobility profile at creation time and relative distance (mobility profile of user to other mobility profile of other users).
  • Members
  • Creation date

When a group is created by a user, they are assigned the administrator rights by default. They can accept or reject requests to join the group, delete members, mute members, create group events, assign subsidiary administrator rights to other users, or edit group details.

Sub administrators will have the same rights as ordinary members, but will also be able to create group events.

Private group posts or communication will be visible only to the members of the group.

Organised group events will automatically be part of the group members’ “My Calendar section”.

As a group administrator, group sub administrator or group member you agree that:

  1. You will not engage in any inappropriate or illegal conduct, or try to use the group for any personal financial gain;
  2. You will not risk or damage the reputation of Community Bond in any way; and
  3. All posts and private group discussions have to be kept private, are not released to any member of the public or discussed with non-group members.

Respecting the privacy of other users

Community Bond allow users to communicate with any community, within the privacy of a private group or publicly within the frame of channels.  As a private group member, administrator or sub administrator, you are prohibited from sharing any group‘s private communication outside the group, without the author's express, prior permission.

Community Bond reserves the right to:

  1. Limit, at our discretion, some user types or some mobility profiles to create or request to join private groups for some or all channels at any point of time; and
  2. terminate your group or your status as a group administrator at anytime, without any warning if you fail to comply with any of these terms of use.
  3. Terminate your group if it’s been inactive for more than 90 days.

Managing your privacy, security and confidentiality

When you voluntarily create any content on the public channels or provide data by making it part of your public profile, this will be shared with other users. We accept no responsibility for what other users or third parties may do with it. It is up to you to decide the privacy level each time you create any type of content. Protecting the privacy of your profile is your responsibility. We caution you not to share sensitive information (such as credit card numbers, or driver's licence numbers) with other users whom you do not know or place such information in your user profile.

Each time you voluntarily create content such as post personal information in public areas of our website, , this information can be accessed by the public and other users and can in turn be used to send you unsolicited communications. Community Bond recommends that you exercise discretion in deciding what information you share on the Internet.

Removal of content and termination

You must not incorporate, upload, link to, refer to or include, in any way, content that Community Bond, in its absolute discretion, considers is inappropriate for inclusion on the website or any Mobile Apps. We will use reasonable endeavours to consult with you prior to removing all or any part of the content. Nonetheless, we reserve the right remove any content without consultation. We also reserve the right to prohibit users who breach these Terms of Use from using the website in the future.

In case of violation of these terms, we reserve the right, among other options, to remove or edit your content, terminate or suspend your account, access rights or ability to use all or parts of our services.

We reserve the right to terminate a user account, or group(s) or any user's access to our website and any of our Mobile Apps, at any time in our sole discretion. If you violate these Terms of Use or our Privacy Policy, we may, require you to remedy any violation and/or take any other actions that we deem appropriate to enforce our rights and pursue available remedies.

You accept that Community Bond has the right ( but not obliged) to delete or deactivate your account, your group(s), block your email or IP address, or otherwise terminate your access to or restrict the use of any of our services, immediately without notice or liability, if we determine, in our sole discretion that you have breached these Terms of Use, violated any law, rule, or regulation, engaged in other inappropriate conduct, or for any other business reason. We also reserve the right to terminate your account or your use of our services or access to content or to groups or to channels or to specific mobility profiles if such use places an undue burden on our networks or servers. We would prefer to avoid such termination or measures; therefore, we may use technology to limit some specific activities, such ( not limited to )as the number of calls to our servers being made or the size of files, volume of user material being posted, and you agree to respect these limitations and not try  to avoid, or bypass them.

You understand and you consent that termination of your user profile may involve deletion of your information such as public profile, posts, general content or groups from our databases. We will not have any liability whatsoever to you for any termination of your user profile or all associated or related deletion of your information.

All user payments are non-refundable. You will not receive other amounts previously charged to you or a refund for any payment for any unused portion of any payment or subscription. Additionally, upon discontinuation, termination, or cancellation or of an account for any reason,

Further, you agree and accept that we will not be liable to you or any third-party for any termination of your access to any of our services. All our indemnities, rights, limitations of liability and provisions shall survive any termination of your membership. You agree not to try to attempt to use our services, website, mobile apps after this termination.

Website and mobile apps usage

You must not use our website to facilitate or participate in any illegal activity or engage in any activity that Community Bond, in its absolute discretion, considers to be inappropriate.

You must not attempt to modify, adapt, translate, sell, reverse engineer, decompile or disassemble any portion of the website or any other websites or any Mobile Apps. You must not attempt to bypass the network firewall and you must not use any part of the website which you are not authorised to use or devise ways to circumvent security in order to access part of the website which you are not authorised to access. This includes but is not limited to scanning networks with the intent to breach and/or evaluate security, whether or not the intrusion results in access.

We may monitor your use of Community Bond to ensure that conduct is appropriate. Any behaviour that could be deemed offensive or inappropriate will not be tolerated. 

We reserve the right to immediately and indefinitely restrict your access to the website in any way considered reasonably necessary if we suspect that you are engaging in any of the above behaviour.

Complaints

Community Bond takes complaints very seriously.

When you contact or send a message to our support system via email or via our contact us page or via our social network pages, we collect the data you have given to us in that message in order to obtain confirmation that you are entitled to receive the information and to provide to you the information you need. We record your request, query or question and our reply in order to increase the efficiency of our business.

If your complaint or question or query reasonably requires us to contact some other person, we may decide to give to that other person some of the information contained in your complaint, query or question. We do this as infrequently and rarely as possible, but whether we do give information, and, if we do, what that information is, this is a matter for our sole discretion.

Community Bond is not responsible for any complaints related to any matters regarding direct contact between users of our website.

Limitation of liability and jurisdiction

Your use of the website is at your sole risk. The content and services are supplied to you on an “as is” and “as available” basis.

While we have taken all due care and precautions in providing the information on our website, we do not provide any warranty either express or implied including without limitation warranties of title or implied warranties of merchantability or fitness for a particular purpose.

From time to time we may host content from third party on our website such as endorsements and advertisements belonging to other traders. We are not responsible for any omissions or errors or in such material as the responsibility for the content of such material rests with the owners of that material.

To the extent permitted by the law, any warranty or condition which would otherwise be implied into these terms and conditions is excluded. We also take all due care in ensuring that our website is Trojan horse, virus, worm, and/or malware free, however we are not responsible for any damage to your computer system(s) which arises in connection with your use of our website or any linked website.

We use the best practices and the industry standard technology designed to help keep your personal information safe. Despite these efforts and measures, please note that no data storage or transmission can be guaranteed to be 100% secure and safe. When you use our services, we want you to feel confident ,  but we cannot ensure or warrant the security of any information you transmit to us. For example ( not limited to this specific example), we cannot control any illegal and/or unforeseen activity of other users that may allow them to get around the privacy or security settings on our website or any Mobile Apps. Consequently, you accept and acknowledge that there are circumstances in which your personal information may be accessed by unauthorised persons. We strictly  limit access to your personal information only to employees who we believe need to come into contact with that information in order to do their jobs in connection with our services.

The liability of Community Bond for any breach of these Terms of Use, any statutory cause of action, common law action or tort (including negligence) in any way is limited as follows:

  1. Community Bond will not be liable for indirect or consequential loss or damage, notwithstanding anything else in this Agreement. This includes loss of profits, loss of any business opportunity, loss of data, interruption of business and damage to computer equipment.
  2. Community Bond’s liability in respect of all other claims by you, or loss or damage to you is limited, for an aggregate of all claims, to the amount of your paid subscription (if any).
  3. Community Bond’s liability for a breach of a condition or consumer guarantee required or implied by law that cannot be excluded, is limited to the maximum extent possible, at our option, to:
  1. the supply of the services again; or
  2. b.payment of the cost of having the services resupplied.

This website and its use are governed by the laws of the State of Victoria and you agree to submit to the jurisdiction to the courts of the State of Victoria, in the event of any dispute.

Indemnity

You agree to indemnify and keep us and our directors, officers, employees and agents indemnified from and against all and any losses, loss of profits, claims, damages, actions, suits, demands, costs (including reasonable legal costs and disbursements on a full indemnity basis), interest, charges and expenses of any kind whatsoever which we may suffer or incur or be called upon to suffer or incur by virtue of:

A) your use of or your inability to use this website or the services

B) any content posted by you on or through this website;

C) any breach of or default by you in respect of any of these Terms of Use; or

D) your violation of any applicable laws, rules or regulations


Community Bond owns the intellectual property rights, including copyright, in all content of this website. Except as necessary for using this website on your browser, or as permitted under the Copyright Act 1968 (Cth) or other applicable laws, no material on this website may be reproduced, adapted, uploaded to a third party, linked to, framed, performed in public, distributed or transmitted in any form by any process without the our specific prior written consent.Intellectual property rights

You must not post material (including content, language, imagery, links or other similar things) that infringes the intellectual property rights of others. For example, you may not include a registered trade mark or copyright material without consent of the owners.

You acknowledge and agree that we may use, copy and edit, for any business purpose, any material submitted by you and that you will receive marketing content from us, unless you chose to opt out.

You must not use any of the information, content, methods or any patent associate with our website or any Mobile Apps to establish and operate a similar product or service offering. If you violate this condition of use, you acknowledge that this will cause damage to Community Bond, who expressly reserves all its legal rights.

By using our website, social network pages, mobile apps, you agree to grant Community Bond an unrestricted, non-exclusive, perpetual irrevocable, fully-paid and royalty-free licence (with the right to sub-licence through unlimited levels of sub-licensees) to copy, use, perform, display, create derivative works of, and distribute your content via any distribution method and in any and all media (known today or later developed in the future) throughout Australia and the world. This includes any comment, feedback, idea or suggestion which you provide to us which we may use to enhance our services or provide new services, new channels or new functionality. You agree that no compensation of any kind will be paid with respect to the content that you submit, upload, post, transmit or make available through our website, social network pages and any Mobile Apps.

Privacy policy

You may use this website without disclosing your identity. However, this website may use devices to collect anonymous traffic data from users. Our Internet server may also automatically record details about any computer used to access this website including the IP address, domain name and browser type, the date and time of access, and details of information downloaded. We use this information for internal purposes and to improve this website.  Any other information supplied to us, including personal information supplied to us voluntarily on this website, is treated in accordance with our Privacy Policy which can be viewed at http://www.communitybond.com.au/privacy

You consent to receiving marketing content from Community Bond, but you can opt out of this at any time by logging into your account and selecting the unsubscribe option.

You consent to having your name and contact details passed on any user you are seeking to contact.

Account deactivation

You can deactivate your account any time via “My Profile & Settings/ Deactivate Account”. If you deactivate your account, we may retain some information about you, in accordance with our Privacy Policy.

Refunds

We do not refund the whole or any part of your subscription (if any) for any reason including but not limited to your failure to use the services, you deactivating your profile or cancelling your account.

Your subscription (if any) will expire at the end of the relevant subscription period, whether or not you have used the services during that period.

Credit Card Payments

Community Bond does not store credit card information. Credit card transactions are processed through reputable third-party financial gateways. You should check the applicable privacy policy of the third-party or financial gateway site to determine, among other things, how they will handle any personally identifiable information they collect from you.

We provide no warranty as to the safety or security of using third-party financial gateways to make any payments to us.

Payments

Any payments made through our website are via the third-party platforms, Paypal and Stripe. Please refer to Paypal and Stripe’s respective terms and conditions for further information.

We do not store your payment details and we provide no warranty as to the safety or security of using Paypal and Stripe to make any payments to us.

Links

For the convenience of our users the website contains links and other pointers to websites operated by third parties. We do not control these websites and we are not responsible for their availability or their content or services and we make no warranty in respect of those links in this regard.

We reserve the right, at our discretion, to modify or remove portions of our Terms of Use at any time and such modification shall be effective immediately upon web posting of the modified Terms of Use. Your continued use of the website shall be deemed to be your conclusive acceptance of the modified Terms of Use.
